LifeBeacon Terms of Use

These Terms of Use ("Terms") govern your use of the LifeBeacon mobile application, website, and related services (collectively, the "Service"), operated by Lunamous Tech, LLC ("Lunamous," "we," "our," or "us").

By downloading, accessing, or using LifeBeacon, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum legal age in your jurisdiction, to use LifeBeacon. If you are under the age of majority, you represent that you have permission from a parent or legal guardian.

2. Description of the Service

LifeBeacon is an AI-assisted productivity application designed to help users organize Actions, Goals, reminders, schedules, selected contacts, saved places, and related information.

Features may include:

• Tap-to-talk voice commands and the Athena assistant.
• Action, Goal, milestone, note, reminder, and planning tools.
• Calendar display, creation, update, deletion, and synchronization when permitted.
• Optional import, account synchronization, classification, and deletion of contacts individually selected by the user.
• User-directed business and place searches, including reuse of confirmed business details.
• Location-based results when permission is granted.
• Natural-language interpretation and AI-generated responses.
• Subscription-based features.

Features may change over time. Material changes that affect personal-information practices will be addressed in the Privacy Policy and through any notice or affirmative choice required by law or platform rules.

3. Your Account

You are responsible for maintaining the confidentiality of your account, maintaining access to your email address, activities occurring under your account, and providing accurate information. You agree not to impersonate another person or use another person's account without authorization.

4. Subscription Services

Some LifeBeacon features require a paid subscription. Subscriptions are managed through the Apple App Store or Google Play. Available plans and included features may change over time as permitted by the applicable store terms and law.

5. Free Trials

If offered, free trials are subject to the terms presented at enrollment. Unless canceled before the trial ends, a trial may convert into a paid subscription under Apple App Store or Google Play billing policies.

6. Billing and automatic renewal

Subscriptions automatically renew unless canceled through the applicable Apple or Google account settings. Payment and refunds are governed by the applicable store. Deleting the app or your LifeBeacon account does not cancel a store subscription.

7. Acceptable use

You agree not to:

• Violate any law or another person's rights.
• Attempt unauthorized access or interfere with the Service or another user.
• Upload malicious software, reverse engineer the Service except where law permits, or circumvent subscription restrictions.
• Abuse AI, voice, account, contact, Places, calendar, or deletion features.
• Use imported contact information to publish, sell, spam, harass, or otherwise misuse another person's information.
• Use LifeBeacon for unlawful marketing, communications, surveillance, or other unlawful purposes.

8. AI and voice features

LifeBeacon includes AI features designed to assist with productivity. AI responses may be inaccurate or incomplete and should not be treated as professional advice. Always verify important information independently.

LifeBeacon currently uses tap-to-talk and does not provide continuous ambient Athena wake listening. Recording begins only when you tap the microphone. AI and voice transmissions require the in-app disclosure and affirmative Continue choice. You may decline or later withdraw that choice and continue using non-AI functions.

You are responsible for the content of your requests and for reviewing any resulting Action, Goal, calendar item, contact match, place result, or other output before relying on it or saving it.

9. No professional advice

LifeBeacon is not intended to provide medical or mental health treatment, legal advice, financial or tax advice, or emergency services. If you require emergency assistance, contact local emergency services immediately.

10. Calendar, reminders, and notifications

LifeBeacon attempts to synchronize reminders and calendar information accurately, but we do not guarantee that reminders, notifications, calendar synchronization, or third-party calendar services will always function without interruption. You remain responsible for verifying important appointments and deadlines.

11. Location and Places services

Location-based features require permission or manual location entry. Business and place results are provided through third-party services. We do not guarantee business accuracy, address, hours, availability, pricing, quality, or continued operation. Confirm important details directly with the business or place.

12. Availability

We strive to keep LifeBeacon available, but do not guarantee uninterrupted operation. The Service may be unavailable because of maintenance, updates, third-party outages, internet failures, device limitations, security measures, or other circumstances.

13. Intellectual property

LifeBeacon, Athena, the LifeBeacon name, logos, graphics, software, and related materials are owned by Lunamous Tech, LLC or its licensors. Except as permitted by law, you may not copy, distribute, modify, reverse engineer, or create derivative works from them.

14. User content and contact imports

You retain ownership of information you create or provide through LifeBeacon. By using the Service, you grant Lunamous a limited, non-exclusive license to process, store, transmit, format, and display that information only as necessary to operate, secure, support, and improve the Service in accordance with the Privacy Policy.

If you choose to import contacts, you direct LifeBeacon to access your device address book and copy only the contacts you affirmatively select. Selected cloud records are limited to the fields disclosed in the import interface and Privacy Policy and may be stored with your LifeBeacon account through Supabase for synchronization across your devices. Unselected contacts and native device contact IDs are not uploaded to LifeBeacon.

You represent that you are authorized to provide and use imported contact information for your personal organizational purposes. You may not use LifeBeacon to import, publish, disclose, sell, spam, harass, surveil, or otherwise misuse another person's contact information or violate privacy, communications, marketing, or other applicable laws.

Lunamous does not claim ownership of your Actions, Goals, notes, selected contacts, confirmed places, or other user content. Our handling of that content is described in the Privacy Policy.

15. Privacy

Your use of LifeBeacon is also governed by the LifeBeacon Privacy Policy at https://lunamous.com/privacy-policy. Review it to understand how the Service accesses, processes, stores, synchronizes, discloses, retains, and deletes information.

16. Third-party services

LifeBeacon integrates with third-party providers for authentication, account storage and synchronization, backend hosting, artificial intelligence, speech processing, Places search, subscriptions, payments, app distribution, and static-media delivery. Use of those services may also be governed by their own terms and privacy notices. The current principal provider list appears in the Privacy Policy.

17. Account deletion and termination

You may stop using LifeBeacon at any time and may request permanent account deletion through LifeBeacon Settings or the public account-deletion process described in the Privacy Policy. Successful account deletion revokes LifeBeacon sessions and removes active user-scoped LifeBeacon account data as described in the Privacy Policy, subject to provider-controlled records and legitimate security, legal, accounting, fraud-prevention, and operational exceptions.

Deleting your LifeBeacon account or the app does not cancel an Apple App Store or Google Play subscription. You must cancel the subscription separately through the applicable store. Apple, Google, and other providers may retain records they control under their own terms and legal obligations.

We may suspend or terminate access if you violate these Terms, your account is used fraudulently, or continued access would create a material security or legal risk. Where appropriate and permitted, we may provide notice or an opportunity to resolve the issue.

18. Disclaimer of warranties

LifeBeacon is provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, Lunamous disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI responses will always be correct, reminders will never fail, synchronization will always succeed, or services will always be uninterrupted.

19. Limitation of liability

To the fullest extent permitted by law, Lunamous Tech, LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of LifeBeacon. Our total liability for any claim relating to the Service will not exceed the amount you paid for LifeBeacon during the twelve months preceding the claim, or US $100, whichever is greater. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

20. Indemnification

You agree to indemnify and hold harmless Lunamous Tech, LLC, its officers, employees, contractors, and affiliates from claims, damages, liabilities, and expenses arising from your misuse of the Service, your unlawful handling of imported contact information, or your violation of these Terms, to the extent permitted by law.

21. Changes to the Service

We may modify, remove, introduce, or discontinue features. We will provide any notice required by law, store rules, or our agreements when a change materially affects your rights or the handling of personal information.

22. Changes to these Terms

We may update these Terms. We will update the Effective Date and provide additional notice when required for a material change. Continued use after updated Terms take effect constitutes acceptance where permitted. If applicable law requires a different form of agreement or affirmative consent, we will request it.

23. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Disputes shall be brought in the state or federal courts located in Lake County, Florida, unless applicable law requires otherwise.

24. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions will remain in full force and effect.

25. Entire agreement

These Terms, together with the Privacy Policy and any subscription terms presented through Apple or Google, constitute the agreement between you and Lunamous regarding LifeBeacon, except where another written agreement expressly applies.

Apple App Store required EULA

LifeBeacon is distributed through the Apple App Store. Unless Lunamous provides a custom end-user license agreement accepted through Apple, Apple's Standard Licensed Application End User License Agreement also applies where required. If these Terms conflict with the Apple Standard EULA regarding Apple's responsibilities or user rights, the Apple Standard EULA controls to the extent of that conflict.
